This Privacy Policy describes how Cergai, LLC, a Delaware limited liability company ("Cergai", "we", "us", or "our") collects, uses, and discloses information when you use the website at cergai.com and the related services (the "Service"). Account information: When you sign up or subscribe to a newsletter, we collect your email address and, if you opt in to SMS delivery, your mobile phone number.
Queries and prompts: The questions, topics, and prompts you submit to Cergai are stored so we can return results, generate newsletters, and improve the Service.
Usage data: We log basic information about how you use the Service, including pages viewed, features used, IP address, browser type, device type, and timestamps.
Cookies: We use cookies and similar technologies to keep you signed in, remember your preferences, and measure how the Service is used. You can disable cookies in your browser, but parts of the Service may not work without them.
Optional information: If you contact us directly, we keep the contents of your message and our reply.

2. How We Use Information

To provide, operate, and maintain the Service, including generating AI responses and delivering newsletters.
To send you the newsletters, verification codes, and service messages you have requested.
To improve, personalize, and expand the Service, including analyzing usage patterns and debugging issues.
To communicate with you about updates, security alerts, and support requests.
To detect, prevent, and address fraud, abuse, or violations of our Terms of Service.
To comply with legal obligations.

3. How We Share Information

We do not sell your personal information. We share information only with the following categories of service providers, and only as necessary to operate the Service:

Hosting and infrastructure: Our servers and databases are hosted on third-party infrastructure providers (including Railway and managed PostgreSQL providers).
Email delivery: Transactional and newsletter emails are sent through Resend.
SMS delivery: Text messages, including verification codes and SMS newsletters, are sent through Twilio. Your mobile phone number and SMS opt-in status are shared with Twilio only for the purpose of delivering the messages you have requested. We do not share mobile phone numbers, SMS opt-in data, or consent information with third parties or affiliates for their marketing or promotional purposes.
AI model providers: Your queries and prompts are sent to third-party large language model providers (including Anthropic, OpenAI, Google, and others) so those models can generate the responses that Cergai synthesizes. These providers process the query under their own terms and privacy policies.
Analytics: We may use standard analytics tools to understand aggregate usage of the Service.
Legal and safety: We may disclose information if we believe in good faith that it is required by law or necessary to protect the rights, property, or safety of Cergai, our users, or others.

4. Data Retention

We retain account information, queries, and usage data for as long as your account is active or as needed to provide the Service. You may request deletion at any time by emailing us at austin@cergai.com. Some information may be retained in backups or for legal, tax, or accounting purposes after deletion.

5. Your Rights

Depending on where you live, you may have the following rights regarding your personal information:

Access: Request a copy of the information we hold about you.
Correction: Ask us to correct information that is inaccurate.
Deletion: Ask us to delete your account and associated information.
Portability: Request your information in a portable format.
Opt-out of marketing: Unsubscribe from emails using the link at the bottom of any newsletter, or reply STOP to any SMS message.
Do not sell / share: We do not sell or share your personal information for targeted advertising. California residents have the right to confirm this under the CCPA.

6. Children

The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us and we will delete it.

We use reasonable administrative, technical, and physical measures to protect your information, including encrypted connections (HTTPS) and access controls. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.

8. International Users

Cergai is operated from the United States. If you access the Service from outside the U.S., your information will be transferred to, stored, and processed in the U.S., which may have different data protection laws than your country of residence.

We may update this Privacy Policy from time to time. When we do, we will post the updated version on this page and change the "Last updated" date at the top. Material changes will be communicated via the Service or by email when appropriate.
